Nursing mother seeks divorce, returns dowry

 

A nursing mother, Rahma Adamu, on Thursday, dragged her husband, Murtala Abdullahi, to Shari’a court sitting at Magajin Gari, Kaduna, seeking divorce.

Adamu said she was no longer in love with her husband and cannot stay in the marriage, and prayed the court to dissolve the marriage through Khul’i.

Khul’i is a type of divorce where a woman returns the dowry paid during her marriage to the husband in exchange for her freedom.

‎She told the court that N150,000 was paid as her dowry during the wedding and she was ready to return it.

‎However, the lawyer of the defendant, Muhammad Abdullahi, opposed it, saying the dowry paid was N200,000 and not N150,000, and prayed the court to give him two weeks for possible reconciliation.

But Halima Umar, the complainant’s lawyer, said her client was not interested in any reconciliation and ready to return the N200,000 to the defendant.

The Judge, Mu’awiyya Shehu, rejected the defendant’s lawyer’s prayer, saying that “in Islam, when a woman wants a divorce, she is allowed to return her dowry.’’

He further explained that the court would not force the complainant to return to the marriage she is no longer interested in, to avoid further troubles.

The judge, therefore, dissolved the marriage and asked Adamu to pay the dowry immediately
